3. Operational Use of Your Information

We use your data primarily to match your qualifications with job vacancies and to run our business efficiently. By submitting your data, you agree that we may use it for the following purposes:

  • Matching and Placement: Assessing your skills and experience against job openings and sharing your Personal Data (including resumes) with our clients for consideration without further specific notice to you, once you are actively engaged with us as a candidate.

  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the new entity as a business asset.

  • Legal Requirements: We reserve the right to disclose your information if required by law or to respond to valid governmental requests, legal process, or to protect our rights or property.

We retain your Personal Data for as long as necessary to fulfill the purposes for which it was collected, or for any longer period required by law or required to maintain a robust candidate pool.

  • Candidate Data: We will retain candidate profiles and associated professional data for an indefinite period (or as long as permitted by law) to allow us to consider you for future opportunities and as records related to completed searches. You are responsible for ensuring your data is kept current.

8. Governing Law and Jurisdiction

This Privacy Policy and your use of the Site and our services are governed by and construed in accordance with the laws of the State of New York, applicable to agreements made and to be entirely performed within the State of New York, without regard to its conflict of law principles.

9. California Residents

This section applies only to California residents and supplements the information in the rest of our Privacy Policy.

The California Consumer Privacy Act (CCPA), as amended by the CPRA, provides California residents with specific rights regarding their Personal Information. As a staffing and recruitment company, we are typically acting as a "Service Provider" when handling data on behalf of a client (a prospective employer). However, when we interact with you directly, we aim to respect your rights as follows:

A. Your Rights

You have the right to request that we:

  1. Right to Know: Disclose to you the categories and specific pieces of Personal Information we have collected about you, the sources of that information, our business purpose for collecting or selling that information, and the categories of third parties with whom we share it.

  2. Right to Delete: Delete any Personal Information about you that we have collected, subject to certain exceptions (e.g., to complete a transaction, detect security incidents, or comply with a legal obligation).

  3. Right to Correct: Request correction of inaccurate Personal Information we maintain about you.

  4. Right to Opt-Out of Sale or Sharing: Direct us not to "sell" or "share" (for cross-context behavioral advertising purposes) your Personal Information. While we do not typically sell candidate data in the traditional sense for monetary value, the sharing of data for targeted marketing may constitute "sharing" under the CPRA.

B. Exercising Your Rights

To submit a request to exercise these rights, please contact us using the information provided in the Contact Us section. We may need to verify your identity and California residency before fulfilling your request.

C. Notice Concerning Sharing and Selling

We do not sell (as traditionally defined for monetary profit) the Personal Information of California residents, including minors under 16 years of age. However, when we share your professional data (e.g., resume/CV) with a client for a job opportunity, this is integral to the employment purpose for which you provided the data and is not considered a "sale" under the CCPA/CPRA, as it is a necessary part of the service you have requested.

We will not discriminate against you for exercising any of your CCPA/CPRA rights.
